This privacy notice describes how Weshare processes Personal Data pertaining to natural persons who Use its Services as Visitors or Users of the Website or Our Users’ Customers (i.e., how such Personal Data is: collected; stored; accessed; processed, and shared) as well as what are the Legal Basis for such Processing activities.

This Privacy Notice is provided to You in accordance with the following Personal Data Protection Legislation:

  • Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016, also known as the General Data Protection Regulation (GDPR), became applicable throughout the EU and EEA on 25 May 2018 having replaced the previoUs Directive 95/46/EC;
  • Directive 2009/136 / EC of the European Parliament and the Council, of 25 November 2009, also known as the ePrivacy Directive, amending Directive 2002/22/EC on universal service and Users' rights in electronic communications networks and services, Directive 2002/58/EC on the processing of Personal Data and the protection of privacy in the electronic communications sector and Regulation (EC) No 2006/2004 on cooperation between authorities responsible for the implementation of consumer protection legislation;
  • The California Consumer Privacy Act 2018 (CCPA), California state assembly bill No. 375 under CHAPTER 55, a law to add Title 1.81.5 (beginning with Section 1798,100) to Part 4 of Division 3 of the Civil Code, on privacy and approved by the Governor on June 28, 2018. Filed with the Secretary of State on 28 June 2018 and applicable from 1 January 2020.

Interpretation and Definitions

Interpretation

The words in which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Notice:

  • Account means a unique Account created for You to access our Service or parts of our Service.
  • Company (referred to as either “the Company”, “We”, “Weshare”, “Us” or “Our” in this Agreement) refers to Weshare Inc., 600 N Broad St 5 562, Middletown, DE 19709 USA.
  • Cookies are small files that are placed on Your computer, mobile device, or any other device by a website, containing the details of Your browsing history on that website among its many Uses.
  • Country refers to: Delaware, United States
  • Device means any device that can access the Service such as a computer, a cell phone/ smartphone, or a digital tablet.
  • Personal Data is any information that relates to an identified or identifiable natural person.
  • Service refers to the Website.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or natural persons employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is Used.
  • Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an Account to Use the Service.
  • Usage Data refers to data collected automatically, either generated by the Use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • Website refers to all of the text, data, information, software, graphics, photographs, and more that we and our affiliates may make available to You, plUs our websites and any services, plug-ins, software, or applications (including Weshare’s WordPress plugin and any Weshare applications) that we may provide altogether.
  • Users refers to the people who have created a Weshare Account.
  • Customers are people who have scheduled a meeting with a Weshare User but may or may not have created a Weshare Account.
  • A Visitor is a person who visits the Weshare Website but may or may not be a Weshare User or a Customer.
  • You means the natural person accessing or Using the Service, or the Company, or other legal entity on behalf of which such natural person is accessing or Using the Service, as applicable.

Any terms defined in the Terms & Conditions and not otherwise defined in this Privacy Notice are hereby adopted by reference in this Privacy Notice.

Disclaimer

The primary purpose of Personal Data Processing is to identify authorized Users (logged-in Users) of Weshare so that they can benefit from its functionalities according to the credentials of their respective User profiles.

Weshare (both as an organization and as each of its team members) is fully aware of the fact that Personal Data may pose a risk to You if accessed by unauthorized third parties; and that is why a set of policies, operational processes, and mechanisms (technological and human) have been developed and set in place; ensuring that the Personal Data entrusted by You to Weshare is maintained, processed and shared in a way that ensures its security, accuracy, confidentiality, and privacy, thus ensuring the protection of Your Personal Data as well as anyone else whose Personal Data You share with our Services.

Collecting and Using Your Personal Data

Types of Data Collected

Introduction

Weshare is a platform that allows its Users to manage their schedules with regard to contacts and meetings with their prospective Customers, and enables CRM functionalities with which our Users may manage their relationships with their Customers.

Personal Data

We collect Personal Data that You provide to Us. Both Your Personal Data as well as the data pertaining to other natural persons which is input into the Services by You or through Your actions as well as the actions of Your Clients/ Customers.

We collect Personal Data that You voluntarily provide to Us when You register on the Website, express an interest in obtaining information about Us or our products and Services, when You participate in activities on the Website or otherwise when You contact Us.

The Personal Data that we collect depends on the context of Your interactions with Us, the choices You make and the products and features You use. The Personal Data we collect may include the following:

Personal Data Provided pertaining to You.

  • Email addresses
  • contact preferences;
  • passwords;
  • payment information and invoicing data;

Personal Data Provided pertaining to both You and Your Customers.

  • This mostly derives from what You input into the Services.

Social Media Login Data.

  • We may provide You and Your Customers with the option to register with Us using Your existing social media Account details, such as your Google Account.

Usage Data

We automatically collect certain information when our Services are Used. This information does not reveal the identity of any natural person (like name or contact information) but may include Device and Usage information, such as the User or Visitor IP address, browser and Device characteristics, operating system, language preferences, referring URLs, Device name, country, location, information about how and when our Services are Used plus other technical information. The Data which composes this information becomes Personal Data where we are able to link the person accessing our Services with a registered User. This information is primarily needed to maintain the security and operation of our Website, and for our internal analytics and reporting purposes, hence it is collected and under the Legal Basis of Legitimate Interest while not colliding with the Legitimate Interest in the privacy of those natural persons who Use our Services nor rendering them at risk.

The information we collect includes:

  1. Log and Usage Data - Log and Usage Data is service-related, diagnostic, Usage and performance information our servers automatically collect when Users or Visitors access or Use our Website and which we record in log files. Depending on how they interact with Us, this log data may include:
    • IP address
    • Device information
    • Browser type
    • Settings
    • Information about a User or Visitor activity on the Website - such as the date/time stamps associated with Usage
    • Pages or files viewed
    • Searches and other actions that are taken - such as which features have been Used
    • Device event information - such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings.
    These are gathered under Legitimate Interest for they are vital to enable our Services, making the Cookies that we gather “Necessary”.
  2. Device Data - We collect Device data such as information about the User or Visitor's computer, phone, tablet, or other Device in Use to access the Website. Depending on the device Used, this Device data may include information such as IP address (or proxy server), Device and application identification numbers, location, browser type, hardware model Internet service provider and/or mobile carrier, operating system, and system configuration information. This is gathered under Legitimate Interest for it is vital to enable our Services, making the Cookies that gather it “Necessary”.
  3. Location Data - We collect location data such as information about our Users' or Visitors' Device location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the Device Used to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells Us the User’s or Visitor's current location (based on IP address). Users and Visitors alike can opt out of allowing Us to collect this information either by refusing access to the information or by disabling Your Location setting on Your Device. Note, however, that if You choose to opt out, You may not be able to use certain functionalities of our Services. This is gathered under Explicit Consent, meaning the Cookies Management Tool allows Users and Visitors to disable these Cookies, therefore where You opt not to disable them, You are Consenting to their Use and therefore to the Processing of this Personal Data.

Information from Google

Weshare allows You to create an Account and log in to the platform Using Google Sign In/Sign Up and connect Your Weshare calendar to Your Google Calendar Account.

Google Account Information

If You decide to register through or otherwise grant Us access to Your Google Account, We may collect Personal Data that is already associated with Your Google Account, such as Your name, email address, see Your personal info, including any personal info You've made publicly available and associate You with Your personal info on Google.

Google Calendar Information

You may also have the option of sharing additional information with Weshare through Your Google Calendar Account. If You choose to connect Your Google Calendar with Weshare. Our calendar integration only checks the duration and free/busy status of the events in Your Google Calendar, so that we don’t book for You meetings when You’re busy. We never store who You are meeting with on Google Calendar, their email address, the meeting title, or any other details about the meetings in Your connected Google Calendar.

Information from Zoom

Weshare allows you to connect your Weshare appointment pages to your Zoom account.

Zoom Account Information

If You decide to grant Us access to Your Zoom Account, We may collect Personal Data that is already associated with Your Zoom Account, such as Your name, email address, see Your personal info, including any personal info You've made publicly available, and associate You with Your personal info on Zoom.

Zoom Calendar & Video Conferencing Information

If You choose to connect Zoom with Weshare. Our Zoom integration will create a unique Zoom meeting link when someone books an appointment on a page that has the Zoom integration enabled. We never store private information available on Your Zoom Account. Including past Zoom meetings, settings, email addresses, or any other information in Your Zoom Account.

Information You Provide Voluntarily

Weshare collects the following information, either directly from Weshare Users, Customers, or Visitors, or through third parties regarding Users, Customers, or Visitors.

Appointment Information

A Weshare User, Customer, or a third party may voluntarily give Us certain information. This can include names, email addresses, and phone numbers; email addresses of other people; the subject of the meeting; and any other information provided to Us or as required by the Weshare User upon scheduling, pursuant to Weshare's Terms & Conditions. If You receive an invitation from a Weshare User but do not wish to become a Weshare User, please contact the Weshare User who sent the invitation through other means to set up Your meeting.

Calendar Information

A Weshare User may connect their calendar with Weshare. Our calendar integration only checks the duration and free/busy status of the events in Your calendar so that we don’t book You when You’re busy. We never store who You are meeting with, their email address, the meeting title, or any other details about the appointments in Your connected calendar.

Billing Information

If You purchase a premium version of Weshare, our third-party payment "Processor” will collect and store Your billing address and credit card information. We store the last four digits of Your credit card number, card type, and its expiration date.

Tracking Technologies and Cookies

You can manage all Cookies in Use by Us, except those which are deemed “Necessary”.“Necessary Cookies” are those which are absolutely necessary to enable the delivery of our Services to You. We do not use persistent Cookies (in the sense that those will profile your actions regardless of being using our Services), all the Cookies in use are session cookies, in the sense that once you stop using our Services, the Cookie will no longer Process information about You.

Use of Your Personal Data

We process Personal Data to identify and invoice our Users. This allows them to manage their schedule and maintain a relationship with their Customers. The reasoning behind processing Personal Data includes the following specific service components:

  • To facilitate Account creation and login process (under Explicit Consent) - If You choose to link Your Account with Us with a third-party Account (such as Your Google Account), we Use the information You allowed Us to collect from those third parties to facilitate Account creation and login process for the performance of the contract.
  • To post testimonials (under Your Consent) - We post testimonials on our Website that may contain Personal Data. Prior to posting a testimonial, we will obtain Your Consent to Use Your name and the content of the testimonial. If You wish to update or delete Your testimonial.
  • Request feedback (under Legitimate Interest) - We may use Your information to request feedback and to contact You about Your Use of our Services.
  • To enable User-to-User communications - We enable communications through 3rd party tools (e.g. Zoom); this derives from Your actions as a User of our Services, meaning it is “triggered” by Your Usage of the Services, hence we act while fulfilling a Contractual Obligation.
  • To manage User Accounts (under Legitimate Interest) - We may use Your information for the purposes of managing Your Account and keeping it in working order.
  • To send administrative information to You (under Legitimate Interest) - We may use Your Personal Data to send You products, services and new feature information and/or information about changes to our terms, conditions, and policies via email.
  • To protect our Services (under Legitimate Interest) - We may use Your Personal Data as part of our efforts to keep our Website safe and secure (for example, for fraud monitoring and prevention).
  • To enforce our terms, conditions, and policies plus, to comply with legal and regulatory requirements or in connection with our contract.
  • To manage Your requests: To attend and manage Your requests to Us.
  • To respond to legal requests (under Legal Obligation) - If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
  • To send You marketing and promotional communications (under Your Consent) - We and/or our third-party marketing partners may use the Personal Data You send to Us for our marketing purposes, if this is in accordance with Your marketing preferences.

Our Service is self-service, meaning registered Users will operate actions and functionalities for the purposes that they define. This makes our registered Users the "Controller" as our Services the "Processor" (as determined under the GDPR).

What this basically means is that there are two contexts of Processing of Personal Data activities inherent to our Services:

  • The context where we Process Personal Data pertaining to Users who have registered with Us, so they can be identified and benefit from the functionalities we make available.
  • The context where those registered Users enter Personal Data pertaining to other natural persons who are their Customers, and in this case, our registered Users bear the sole responsibility for the Personal Data and purpose or scope of inherent Personal Data Processing activities.

Transfer of Your Personal Data

We may process or share Your data that we hold based on the following legal basis:

  • Consent - We may process Your data if You have given Us specific consent to Use Your Personal Data for a specific purpose.
  • Legitimate Interest - We may process Your data under Legitimate Interest in the sense that such processing is required to enable the Services while not colliding with Your Privacy rights nor rendering You at risk and example of this consists of the companies that act as our "Processors” in the sense that they contribute with their services to the hosting of our platform or enable some specific functionalities that You will be using.
  • Legal Obligations - We may disclose Your Personal Data where we are legally required to do so in order to comply with applicable law, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

We may also need to share or transfer Personal Data pertaining to You in connection with or during negotiations of, any merger, financing, or acquisition of all or a portion of our business to another company.

Additionally, You may opt to login into our Service Using Your Google Account, which means both we will become aware of Your Google Account, as well as Google will become aware of the fact that You are Using our Services. Please refer to Google information on this here: Connect Weshare & Google

Also, we Use Zoom to enable You to entice communication with Your Customers, which also implies that Zoom will have access to both Your Data as well as Your Customers’ Data. Please refer to Zoom information on this here: Connect Weshare & Zoom

Please note that we do not control and are not responsible for, other Uses of Your Personal Data by Google or Zoom, as You are already registered with these 3rd parties. We recommend that You review their privacy notice to understand how they collect, use, and share Your Personal Data, and how You can set Your privacy preferences on their sites and apps.

We have Data Processing Agreements in place with these Partners where the parties commit to observe applicable Personal Data Protection legislation requirements and having in place adequate technical, and organizational processes measures that ensure the Security of Your Personal Data and that it remains Confidential, hence ensuring Your Privacy.

International Transfer of Your Personal Data

Our servers are located in the United States by Digital Ocean, which means Your Personal Data is hosted there. When You join our Service You are Providing Us with Your Explicit Consent for the Processing to occur in the U.S.

If You are not a resident in the European Economic Area (EEA) or United Kingdom (UK), then Your country may not necessarily have data protection laws or other similar laws as comprehensive as those in the EEA or the UK. We will however take all necessary measures to protect Your Personal Data in accordance with this privacy notice and the highest legal standard being applied, which at present date is the EU/ EEA General Data Protection Regulation (the GDPR).

Retention of Your Personal Data

We will only keep Your Personal Data for as long as it is necessary for the purposes set out in this privacy notice - meaning while You are using our Services, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this notice will require Us keeping Your Personal Data for longer than the period of time in which Users have an Account with Us.

Our Users act as "Controllers” (as defined under the GDPR) which means that any Personal Data which is input by our Users (pertaining to their Customers) is done so under their responsibility and to be erased at their option or discretion.

Security of Your Personal Data

We have implemented appropriate technical and organizational security measures designed to protect the security of any Personal Data we process in strict alignment with both IT security standards and best practices as well as applicable legal requirements, driven by a Corporate Data Processing Impact Assessment as determined under Article 35 of the GDPR.

Privacy Rights

Under applicable Personal Data Protection Legislation, the Data Subject has the following set of established rights:

[GDPR] Right of access. The right to obtain from the "Controller" confirmation as to whether their Personal Data is being processed, and, if so, to access such Personal Data as well as related information. Weshare will share the Personal Data over a secure channel, and that (depending on the type of Data as well as volume) may imply the need to convey a “password” via an alternative communication channel to the data Subject to ensure authorized secure access. Participants may exercise this right by reviewing information on the Weshare website User Account area or by submitting a request as per herein defined ahead in this document which is the application process for those Data Subjects who are not a Weshare Participant.

[CCPA] Right to know and access Your Personal Data – similar to the Right of Access under the GDPR, California residents have the right to:

  • Know the categories of Personal Data we collect and the categories of sources from which we got the information.
  • Know the business or commercial purposes for which we collect and share Personal Data.
  • Know the categories of third parties and other entities with whom we share Personal Data, and
  • Access the specific pieces of Personal Data we have collected about You.

[GDPR] Right to rectification. The right to obtain the rectification of inaccurate Personal Data pertaining to that Data Subject. Participants may directly amend existing information on the Weshare website User Account area or by submitting a request as per herein defined ahead in this document which is the application process for those Data Subjects who are not Weshare Participants.

[GDPR] Right to erasure. The right to have Personal Data pertaining to them that is under Processing by Weshare erased and, therefore, Processing stopped, unless a legal duty or have a legitimate ground to retain certain data prevents Weshare from observing such right, in which case the Data Subject shall be duly informed. This right may be exercised by submitting a request as defined in the procedure stated below in this section.

[CCPA] Right to deletion – again in a similar manner to what the GDPR rules, natural persons who reside in the state of California may, in some circumstances, ask Us to delete their Personal Data. We may refuse the exercise of such right if it prevents Us from exercising legal defense, we cannot do it driven by a legal obligation or there is the risk of doing so, not being able to fulfill any open contractual obligations.

[GDPR] The right to restrict processing. Under relevant conditions set out by the law, the right to request and have in place processing restrictions (in scope and purpose) towards Personal Data that pertains to them. When exercising this right, the Data Subject must be specific about which processing activities are being requested to be restricted and the "Controller" shall provide feedback to the Data Subject on either the completion of the request or any potential collateral impact that may derive from implementing the requested objection to Processing, asking for additional confirmation prior to implementing the request. This right may be exercised by submitting a request as defined in the procedure stated below in this section.

[GDPR] The right to object to processing. The right to object to processing activities that have been qualified under this Privacy Notice has occurred under the Legal Basis of Legitimate Interest by the side of Weshare. The exercise of this right may also occur where the Data Subject wishes to opt out from an existing Service (and not necessarily cancel the Service). When exercising this right, the Data Subject must be specific about which processing activities are being requested to stop and the "Controller" shall provide feedback to the Data Subject on either the completion of the request or any potential collateral impact that may derive from implementing the requested objection to Processing, asking for additional confirmation prior to implementing the request. This right may be exercised by submitting a request as defined in the procedure stated below in this section.

[CCPA] Right to opt out of sales – We do not sell Your data.

[GDPR] Right to data portability. The right to receive the Personal Data pertaining to that Data Subject, in a structured, commonly Used, and machine-readable format as well as the right to transmit such Personal Data to another "Controller" without hindrance. Weshare will share the Personal Data over a secure channel, and that (depending on the type of Data as well as volume) may imply the need to convey a “password” via an alternative communication channel to the data Subject to ensure authorized secure access. Customers may directly amend existing information on Weshare’s website User Account area or by submitting a request as per herein defined ahead in this document which is the application process for those data Subjects who are not Weshare Customers.

[GDPR] Right to be informed about a Personal Data Breach. The Data Subject has the right (and it is the "Controller"’s obligation by law to ensure it) to be informed of any unauthorized disclosure or potential disclosure of his/ her Personal Data to unauthorized 3rd parties within 72 hours of its occurrence.

[GDPR] Right to lodge a complaint with a supervisory authority. The right to lodge a complaint regarding Weshare’s Processing activities over his/ her Personal Data towards any of the EU Member States' data protection Supervisory Authorities. Weshare is however also available to provide any clarification towards those Data Subjects who may feel that the Processing of the Personal Data that pertains to them has negatively impacted them or somehow breached their rights under GDPR and/or the right to Privacy, having such Personal Data processed in a secure manner and Confidentiality assurance. Data Subject may submit a complaint via the request process as per herein defined ahead.

[CCPA] Right to be free from discrimination – You may exercise any of the above rights without fear of being discriminated against. We are, however, permitted to provide a different price or rate to You if the difference is directly related to the value provided to You by Your data. For any of the above-mentioned CCPA-related rights, You may designate an authorized agent to make a request on Your behalf. In the request, You or Your authorized agent must provide information that is sufficient for Us to confirm the identity of an authorized agent. We are required to verify that Your agent has been properly authorized to request information on Your behalf and this may take additional time for Us to fulfill Your request.

Opting Out Of Third-Party Service Providers

Account Information

If You would at any time like to review or change the information in Your Account or terminate Your Account, You can:

  • Log in to Your Account settings and update or terminate Your Account.
  • Contact Us Using the contact information provided.

Upon Your request to terminate Your Account, we will deactivate or delete Your Account and inherent information from our databases. However, we may retain some information in our files (which may include Personal Data) to prevent fraud, assist with any investigations, and/or comply with applicable legal requirements.

Affiliate disclosure

Weshare is an affiliate of many online tools, services, and products. Links on this website may be affiliate links and We may earn commissions for purchases that are made by Users and Visitors of our Services. These are promotional links that can be used to track a User or Visitor purchase and credit it to Weshare. This comes at no additional cost to You or Your Customers and Our goal is to provide the very best reviews and recommendations. If You have any questions, please contact Us.

Bear in mind that when a User or Visitor is moved to a website of an affiliate of Ours’, the scope and purpose of Personal Data Processing activities on those third party websites is of the entire and sole responsibility of those entities; therefore those who visit or use those websites need to read the respective Privacy Policies & Notices and will use those websites at their own risk. We are not responsible nor liable for the Processing of Personal Data performed by those third parties. Additionally, when moved to another website, You should take special note checking the Cookies being used on those websites, for the inherent Processing of Personal Data pertaining to You may vary significantly from what We do.

Controls for DO-NOT-TRACK Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting You can activate to signal Your privacy preference not to have data about Your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates Your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform You about that practice in a revised version of this privacy notice.

Updates To The Privacy Notice

We may update this privacy notice from time to time. The updated version will be indicated by an updated "Last updated" date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify You either by prominently posting a notice of such changes or by directly sending You a notification. We encourage You to review this privacy notice frequently to be informed of how we are protecting Personal Data that pertains to You.
